  We inform you that the “Interim Regulations on Identification of Overseas High-end Talents and Scarce Talents in Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone” has been examined and approved by municipal government and shall take effect as of January 1, 3013. Please implement them accordingly.

  Interim Regulations on Identification of Overseas High-end Talent and Scarce Talent in Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone
  Article 1 These Regulations are enacted in accordance with “Official Reply of the State Council on Overall Development Planning of Qianhai Shenzhen-Hongkong Modern Service Industry Cooperation Zone”(State Letter [2010] No.58), “Official Reply of the State Council on Relevant Policies of Supporting Development and Opening-up of Qianhai Shenzhen-Hongkong Modern Service Industry Cooperation Zone”(State Letter [2012] No.58) and “Regulations of Shenzhen Special Economic Zone and Qianhai Shenzhen-Hongkong Modern Service Industry Cooperation Zone”, in light of concrete conditions, with the purpose of earnestly settling down identification work of overseas high-end talent and scarce talent in Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone (hereinafter referred to as “Qianhai”).
  Article 2 These Regulations constitute the supporting measures of “Interim Regulations on Individual Income Tax Subsidies of Overseas High-end Talents and Scarce Talent in Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone” (hereinafter referred to as “Regulations on Individual Income Tax Subsidies”) in implementing talents identification work.
  Those who have enjoyed the preferential policies of “Interim Measures on Industrial Development and Innovation Talent Award of Shenzhen Municipality” will no longer enjoy individual income tax subsidies of overseas high-end talents and scarce talents in Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone. 
  Article 3 The identification of overseas high-end talents and scarce talents shall be in accordance of the demand of Qianhai on overseas talents introduction, adhere to scientific objectivity, industry recognition and universally recognized principles on the basis of openness, fairness and equity.
  Article 4 Talent identification work shall adopt the assessment methods of voluntary application, auditing cognizance, connecting evaluation and verification. The identified quota is unlimited in principle.  
  Article 5 Under the leadership of municipal talent work leading group, Authority of Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone (hereinafter referred to as “ the Administration Bureau of Qianhai”) is responsible for the identification work of overseas high-end talents and scarce talents in Qianhai.
  Article 6 Overseas high-end talents and scarce talents who file an application for identification shall meet the following basic qualifications:
  (1) Personage with foreign nationality, or Hong Kong, Macao and Taiwai residents, or overseas Chinese obtained long-term residency abroad and returned overseas talents; 
  (2) Enterprises and related institutions founded or serviced (hereinafter referred to as the ‘affiliated units’) belong to key developing industrial fields in Qianhai of finance, modern logistics, information services, technology services and other professional services. 
  (3) Establish businesses in Qianhai or work in enterprises and relevant organizations registered in Qianhai;  
  (4) Pay individual income tax in accordance with the law in Qianhai 
  Specific identification standards shall be separately formulated by Admiration Bureau of Qianhai in accordance with the concrete conditions of Qianhai construction, industrial development and talents shortage situation, and reported to municipal government for approval before implementation.
  Article 7 Applicants and affiliated units being compliance with one of the following circumstances, shall not declare overseas high-end talents and scarce talents:
  (1) Do not pay taxes in accordance with the law; 
  (2) Have a bad credit record;
  (3) Conduct behaviors of infringement of intellectual property rights; 
  (4) Conduct behaviors of other violations of laws and regulations.
  Article 8 Procedures on identification of overseas high-end talents and scarce talents:
  (1) Personal declaration. Applicants file applications to affiliated units and provide relevant evidentiary materials.
  (2) Unit review. Affiliated units of applicants review the relevant conditions and employment circumstances of applicants, and submit relevant materials to Administration Bureau of Qianhai after review.  
  (3) Talent identification. Administration Bureau of Qianhai conduct talent identification in accordance with related requirements and specific certification standards mentioned in Article 6 and Article 7.
  (4) Publicity. For qualified personnel, make publicity to society.
  (5) Issuing identification reports. Administration Bureau of Qianhai issue identification reports to overseas high-end talents and scarce talents who with no objection to the publicity and submit to the municipal talent work leading group for record.
  Article 9 Identification report issued by Administration Bureau of Qianhai and other relevant information of individuals and units serve as basis for overseas high-end talents and scarce talents to enjoy “Regulations on Individual Income Tax Subsidies” in Qianhai.
  Article 10 Identification report will be valid for one year. At the beginning of each year, affiliated units of applicants shall in accordance to talents identification standards, review and summarize applicants’ concrete conditions and report to Administration Bureau of Qianhai to conduct identification. Annually in the fourth quarter, Administration Bureau of Qianhai report talent identification works for this year to municipal talent work leading group.
  Article 11 Applicants and affiliated units shall truthfully provide declaration materials and responsible for the authenticity and accuracy of materials. Administration Bureau of Qianhai shall promptly accept and examine talent identification and be subject to social supervision.   
  Article 12 These Regulations shall take effect as on January 1st, 2013.
